These Terms and Conditions of Sale ("Terms") govern all purchases made through GuitarFight LLC ("GuitarFight," "we," "us," or "our"). By purchasing any product from GuitarFight, the purchaser ("Buyer") agrees to be bound by these Terms.
Sales are limited to customers located within the United States.
GuitarFight does not sell or ship internationally.
Buyer must be at least eighteen (18) years of age and legally authorized to use the payment method submitted for purchase.
GuitarFight specializes in collectible, used, vintage, and previously-owned musical instruments.
Every effort is made to accurately describe each instrument. All photographs, videos, descriptions, specifications, and written representations form part of the product description.
By completing a purchase, Buyer acknowledges that the listing photographs and written description constitute part of the product description and agrees to rely upon them when making a purchasing decision.
All guitars are sold in the condition described and photographed. Minor cosmetic imperfections, finish checking, wear, aging, fret wear, oxidation, setup preferences, and normal signs of use are not considered defects.
Due to the subjective nature of musical instruments, differences in tone, feel, setup preferences, action height, string gauge, pickup height, weight, balance, neck profile, and similar characteristics do not constitute defects.
All payments are processed through Stripe using valid credit cards.
GuitarFight reserves the right to refuse, delay, verify, or cancel any transaction suspected of fraud, unauthorized use, or suspicious activity.
Ownership of the instrument remains with GuitarFight until payment has been successfully processed and the instrument has been delivered to the Buyer.
To protect both buyers and sellers from fraud, GuitarFight reserves the right to require identity verification before shipment.

GuitarFight may cancel or refuse any transaction if requested verification is not provided or cannot be reasonably verified.
All shipments are:
GuitarFight will provide tracking information within two (2) business days of purchase.
Every guitar is photographed, documented, and its serial number recorded immediately before shipment. GuitarFight also documents the packing and shipping process.
GuitarFight does not ship to freight forwarders, package forwarding companies, virtual mailbox services, hotels, temporary accommodations, or similar third-party receiving locations.
Requests to change the shipping address after purchase may result in cancellation of the order.
Buyer agrees that carrier tracking records, adult signature confirmation, delivery scans, shipping records, photographs, and other carrier documentation may be used as evidence of successful delivery.
Claims of non-delivery must be reported within five (5) calendar days of the carrier's recorded delivery date.
Buyer has five 48 Hours following confirmed delivery to inspect and evaluate the instrument.

Any modification immediately voids return eligibility.
If an instrument arrives damaged, Buyer must notify GuitarFight within 24-Hours of delivery.

Buyer must obtain a return shipment tracking number within the 48-Hour inspection period.
Upon receipt of the returned instrument, GuitarFight will inspect the instrument within two (2) business days.
If the shipping damage claim is verified, GuitarFight will issue a full refund of the purchase price.
For instruments sold for $5,000 or more, additional documentation may be required in the event of a shipping damage claim.
If shipping damage is alleged, Buyer agrees to provide:
Failure to provide such documentation may affect GuitarFight's ability to verify and process a shipping damage claim.
This policy applies only to shipping damage claims and does not affect the Buyer's right to return an instrument during the evaluation period.
Buyer may return an instrument during the five-day evaluation period for any reason.

Original shipping charges are non-refundable.
Refunds will not be issued until the returned instrument has been received, inspected, and verified.
Returned instruments must be received in substantially the same condition in which they were originally shipped.
If GuitarFight determines that the returned instrument has sustained additional wear, damage, modifications, missing parts, diminished value, or other changes, GuitarFight may deduct a reasonable amount from the refund based upon the diminished market value of the instrument.

Such determinations will be made in good faith following inspection and documentation.
No refund will be issued until GuitarFight verifies that the returned instrument is the same instrument originally shipped.
Serial numbers, photographs, identifying marks, hardware configurations, and other identifying characteristics may be used for verification.
Any attempt to substitute, exchange, alter, tamper with, or misrepresent the returned instrument voids all refund rights.
GuitarFight does not offer partial refunds.
The sole remedy available to Buyer is return of the instrument pursuant to these Terms.
Buyer agrees to contact GuitarFight before initiating any chargeback or payment dispute and provide a reasonable opportunity to resolve the matter.
GuitarFight reserves the right to provide photographs, shipping records, serial number records, communications, inspection reports, tracking records, signature confirmations, and transaction documentation in response to any payment dispute.To the maximum extent permitted by law, GuitarFight shall not be liable for indirect, incidental, consequential, special, or punitive damages arising from any purchase.
GuitarFight's maximum liability shall not exceed the purchase price actually paid for the instrument.
These Terms shall be governed by the laws of the State of Arizona.
Any legal action arising from a transaction with GuitarFight shall be brought exclusively in the state or federal courts located within Arizona.
Any dispute, claim, or controversy arising out of or relating to the purchase of any product from GuitarFight LLC, including the interpretation, applicability, enforceability, or formation of these Terms, shall be resolved exclusively through final and binding arbitration rather than in court.
The arbitration shall be conducted in the State of Arizona by a single arbitrator and shall be governed by the Federal Arbitration Act and applicable Arizona law.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.
Judgment on any arbitration award may be entered in any court having jurisdiction.
Notwithstanding the foregoing, GuitarFight may seek injunctive relief or pursue claims involving fraud, intellectual property rights, or unauthorized use of its property in a court of competent jurisdiction.
Buyer and GuitarFight agree that any dispute shall be brought solely in an individual capacity and not as a plaintiff or class member in any purported class action, collective action, representative action, or private attorney general proceeding.
Buyer expressly waives any right to participate in a class action, collective action, representative action, or consolidated proceeding against GuitarFight.
The arbitrator shall have no authority to hear or arbitrate any class, collective, representative, or consolidated claim.
If this Class Action Waiver is found unenforceable, then the arbitration provision shall be null and void to the extent required by applicable law.
In any dispute arising from a transaction with GuitarFight LLC, the prevailing party shall be entitled to recover its reasonable attorneys' fees, arbitration fees, court costs, expert witness fees, and other costs incurred in enforcing its rights.
These Terms constitute the entire agreement between Buyer and GuitarFight LLC regarding the purchase and sale of instruments and supersede any prior communications or understandings.
